1. Purpose
This Acceptable Use Policy (“AUP”) defines the standards of conduct required of all users of the MagicBook platform, including the website, mobile application, and all related services (collectively, the “Service”). This AUP is incorporated by reference into and forms part of MagicBook’s Terms of Service.
MagicBook is a platform for creating personalized, AI-illustrated children’s storybooks. Its core purpose is to produce joyful, age-appropriate content for children. All use of the Service must be consistent with that purpose.
Violations of this AUP may result in immediate account suspension, permanent termination, forfeiture of credits and paid subscriptions without refund, and referral to law enforcement where applicable.
2. Eligibility and Account Use
2.1 Age Requirement
You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you are 18 years of age or older.
2.2 One Account Per Person
You may maintain only one account per individual. Creating multiple accounts to circumvent restrictions, obtain additional free credits, or evade a suspension or ban is prohibited.
2.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You may not share your account with others or allow others to use your account. You must notify us immediately at security@themagicbook.app if you suspect unauthorized access to your account.
2.4 Accurate Information
You must provide accurate and truthful information when registering and using the Service. Providing false information, including misrepresenting your relationship to a child or your authority to submit a child’s photograph, is a material violation of this AUP.
3. Child Safety — Absolute Prohibitions
The following conduct related to minors is strictly prohibited and will result in immediate permanent termination and referral to law enforcement, including the National Center for Missing and Exploited Children (NCMEC) where required by law:
- Submitting any photograph of a child that is sexually suggestive, exploitative, or violates child safety laws in any jurisdiction
- Using the Service to create content that sexualizes, exploits, endangers, or demeans children in any way
- Uploading photographs of children you do not have legal authority to submit (i.e., you are not the parent, legal guardian, or an educator with documented parental consent)
- Using the Service to produce content that could be used to groom, target, or harm a child
- Attempting to circumvent the child safety guardrails built into the AI generation system
- Creating profiles using photographs of children obtained without consent
4. Prohibited Content
You may not use the Service to create, request, generate, store, transmit, or distribute any content that:
4.1 Harmful or Illegal Content
- Is illegal under any applicable law or regulation
- Constitutes, promotes, or facilitates child sexual abuse material (CSAM) in any form
- Promotes, glorifies, or facilitates violence, terrorism, or acts of mass harm
- Constitutes credible threats of harm against any individual or group
- Involves the non-consensual sharing of intimate images
- Violates the privacy rights of any individual, including unauthorized use of a person’s name, image, or likeness
4.2 Hateful or Discriminatory Content
- Contains hate speech targeting individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic
- Promotes or glorifies discrimination, segregation, or supremacist ideologies
- Degrades or dehumanizes any person or group
4.3 Deceptive or Manipulative Content
- Impersonates any person, company, or organization in a misleading way
- Depicts or attributes fictional statements, actions, or scenarios to real, identifiable public figures (e.g., celebrities, politicians, public officials) without their consent, in a manner that could mislead a child or create a false impression of endorsement
- Contains false factual claims about real individuals or organizations
- Is designed to deceive a child in a manner harmful to their wellbeing
- Constitutes phishing, fraud, or social engineering
4.4 Intellectual Property Violations
- Infringes the copyright, trademark, trade secret, or other intellectual property rights of any third party
- Reproduces substantial portions of copyrighted text, artwork, or other protected works without authorization
- Deliberately replicates the art style or character designs of a specific copyrighted property in a manner that creates consumer confusion
4.5 Political and Campaign Content
- Constitutes political campaign material, election-related advocacy, or partisan messaging
- Is designed to influence a political election, ballot measure, or legislative action
- Contains political propaganda targeted at children
5. Prohibited Uses of the Platform
5.1 Technical Abuse
You may not:
- Attempt to reverse engineer, decompile, disassemble, or derive source code from the Service
- Probe, scan, or test the vulnerability of the Service or any related system
- Introduce malware, viruses, Trojans, ransomware, or any malicious code
- Attempt to gain unauthorized access to any account, system, or data
- Use automated bots, scrapers, or scripts to access the Service except via the officially documented API
- Conduct denial-of-service attacks or take any action that unreasonably burdens or disrupts the Service’s infrastructure
5.2 API and Integration Abuse
If you access the Service via API:
- You must comply with all rate limits, usage restrictions, and technical guidelines in our API documentation
- You may not use the API to build a competing service that substantially replicates MagicBook’s core functionality
- You may not resell API access to third parties without a written enterprise agreement
5.3 Commercial Misuse
Without a commercial license or explicit written agreement from MagicBook:
- You may not resell, sublicense, or commercially redistribute books generated through the Service for profit in excess of the cost of production (i.e., you may print a book you create and gift it, but you may not operate a book-reselling business using our platform)
- You may not use the Service to generate content for third-party clients on a commercial basis (freelancing or agency use requires an enterprise agreement)
- You may not scrape, collect, or republish content generated by other users
5.4 Circumvention
You may not attempt to:
- Bypass, disable, or circumvent any content moderation, safety filter, or guardrail built into the AI generation system
- Use prompt injection, jailbreaking techniques, or adversarial inputs to cause the AI to generate prohibited content
- Use the Service in a way intended to test its safety limits rather than to create legitimate children’s books
5.5 Sanctions and Export Control Violations
You may not use the Service in violation of applicable export control laws, trade sanctions, or embargoes, including those administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) and the U.S. Department of Commerce’s Bureau of Industry and Security (BIS).
6. Photograph Standards
All photographs submitted to the Service must meet the following standards:
- The subject of the photograph must be a real child for whom you have authority to submit their image
- Photographs must be appropriate — standard snapshots, school photos, family portraits, and similar images are acceptable
- Photographs must not contain nudity of any kind
- Photographs must not depict harm, abuse, or dangerous situations
- Photographs must be of sufficient quality for AI processing (minimum 300×300 pixels recommended)
- You must own the photograph or have the right to use it for this purpose
- Photographs must not contain visible personally identifiable information (such as name badges, addresses, or identification documents) other than the child’s face
7. Story Content Standards
All story inputs (themes, premises, character descriptions, and custom instructions) must:
- Be appropriate for children in the age group you specify
- Not contain or request adult, violent, or disturbing content
- Not request content that would be harmful, frightening, or psychologically damaging to a child
- Not request content that demeans, stereotypes, or humiliates any real or fictional person
Story inputs requesting the following will be declined by our AI guardrails and, if persistent, may result in account review:
- Death or detailed descriptions of dying, even metaphorical
- Graphic violence or bodily harm
- Adult romantic or sexual content
- Horror themes not age-appropriate for the child’s specified age
- Drug use, alcohol use, or illegal activity
8. Accessibility
MagicBook is committed to providing an accessible platform. Users may not use the Service in a manner that intentionally undermines accessibility features or prevents other users, including users with disabilities, from using the Service. If you encounter an accessibility barrier, please contact accessibility@themagicbook.app.
9. Reporting Violations
If you encounter content or conduct on the Service that violates this AUP, please report it immediately:

We take all reports seriously and will investigate and respond within 5 business days for non-emergency matters.
10. Enforcement
MagicBook reserves the right, in its sole discretion, to:
- Remove any content that violates this AUP
- Issue a warning for first-time or minor violations
- Temporarily suspend an account pending investigation
- Permanently terminate an account for serious or repeated violations
- Forfeit any unused credits or subscription time without refund for violations of Sections 3, 4, or 5
- Report violations of law to appropriate law enforcement authorities
- Preserve and disclose account information and content where required by law or where we believe in good faith that preservation or disclosure is reasonably necessary to comply with legal process
Determinations of what constitutes a violation are made by MagicBook in its reasonable judgment. You may appeal a suspension or termination by contacting appeals@themagicbook.app within 14 days of the action. We will review appeals and respond within 10 business days.
11. Changes to This Policy
We reserve the right to update this AUP at any time. Material changes will be communicated via email and notice on the Service at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated AUP.
